A defendant shall be punished by imprisonment for one year.

Punishment of the crime

1. The Defendant: (a) at around 2011, the credit card arrears amount was KRW 8 million for three card companies; (b) around 10,000,000,000 credit loans was personal loaned to KRW 10,000; (c) the card was suspended and used for the credit card of KRW 600,000 per month in arrears; (d) credit card loans were used for the credit card of KRW 150,160 per month; and (e) the card amount used under the name of KRW 70-1,50,000 per month was in the status of KRW 70,000 per month; and (e) around August 201, the credit card amount was in the status of KRW 350,000 per month upon filing an application for individual rehabilitation procedures; and (e) even if the credit card amount was paid to KRW 270,000 per month, the Defendant did not refund the loan amount to others under the name of another person, even if having been repaid.

On March 22, 2011, the Defendant made a false statement to the victim C at the E office located in Busan-gu, Busan-gu, that “I will complete payment within the following month if I lend cash of 5.60,000 won.”

However, the facts did not have the intent or ability to repay the above even if they borrowed the above money.

Nevertheless, the Defendant, including by deceiving the victim and receiving KRW 560,00 from the victim as the borrowed money, received the total sum of KRW 24,158,000 from around that time to September 25, 2012, as shown in the attached Table 1, from around that time, the Defendant acquired the victim’s total sum of KRW 24,158,00 from the victim.

B. Around May 17, 2012, the Defendant committed a crime against the Victim F with the said E office, stating that “A loan is sought from a credit business entity. If a loan is granted by a lending business entity, the Defendant would not have any problem with full payment of interest and with full payment of principal.”
