A defendant shall be punished by imprisonment for not less than eight months.
However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
From May 201 to June 201, the Defendant operated a restaurant with the trade name “D” in the name of “D” in the name of “D” from “Pju City” to “D” from “Pju City” to “D”. The Defendant, in turn, had been aware of personal information, such as the resident registration number of the said C, by obtaining a credit card issued in the name of “C” and used it for the operation
1. Crimes related to Samsung Cards;
A. On June 27, 2011, the Defendant forged a private document and the instant investigation document: (a) at the above restaurant around June 27, 201; (b) the Defendant was committed as if the Defendant was a counseling party E with the care of the Defendant; (c) the document stating “C”, “F” in the resident registration number column, “G” in the mobile phone circuit column, and “C H 101” in the house column; and (d) the applicant for membership means the applicant for membership by entering the “C” in the personal information column and signing the “C” in the name next to the name; and (c) continuously forged one copy of the “application for membership of Samsung Card Member” in the name of Samsung, which is a private document related to the rights and obligations without authority, and continuously exercised the forged fact as if it were a document duly formed.
B. The Defendant: (a) issued an application to join Samsung Card Member Co., Ltd. with the above “C” at the time and place of “A”; (b) received one (the card number I) Samsung Card Co., Ltd. from the victim Samsung Card Co., Ltd.; and (c) was issued with one (the card number I) on July 1, 201; (d) as if he had been duly entitled despite the absence of a right to use the name Samsung Card from K located in J at the time of the strike, around July 1, 201, he did so as if he had been given a lawful right to use the said Samsung Card; and (e) paid the price of KRW 28,020 with the said Samsung Card; and (e) received a cash service equivalent to KRW 11,142,707 in total from the time to May 31, 2012, as indicated in the list of crimes No. 1.
