Reasons
Punishment of the crime
[criminal history] The Defendant was sentenced to imprisonment with prison labor for a violation of the Narcotics Control Act at the Incheon District Court on November 28, 2012 and completed the execution of the sentence at Daegu Prison on December 25, 2013.
[Criminal facts] Although the Defendant is not a person dealing with narcotics, and is not a person dealing with narcotics, the Defendant did not deal with the clophophones (one philophones, hereinafter philophones), it received, administered, and received marijuana as follows.
1. On January 4, 2016, the Defendant received approximately 0.35 gramopons from E and approximately 0.5 gramopons from E in the X-ray car parked on the road near the Southern-gu Incheon Metropolitan City, at around 6:00, and received approximately 0.5 gramopons from E.
After the same day, the Defendant sent approximately 0.07gg of philophones received from the Defendant’s residence in the Nam-gu Incheon Metropolitan City, and then injected into the Defendant’s arms after being melted with water.
Accordingly, the defendant accepted philophones and marijuana, and administered philograms.
2. On January 13, 2016, the Defendant administered a phiphone in the manner of inserting approximately 0.07g grams among the phiphones received from H located in Nam-gu Incheon Metropolitan City, and melting them into the Defendant’s arms.

(the receipt of philophones), Article 61(1)6, and Article 4(1)2 of the Narcotics Control Act (the receipt of marijuana).
