1. The Defendants shall be punished by imprisonment with prison labor for eight months.

2. However, it is against the Defendants for two years from the date of this decision.

Punishment of the crime

1. Defendant B: (a) around 02:10 on August 20, 2014, at the 1103 parking lot of Kimhae-si, Kim Jong-si, the Defendant received a request for a drinking reduction due to the suspicion of drinking alcohol from Kimhae-si Police Station E District Unit of the Kimhae-gu Police Station, and from slope G, who was in charge of drinking alcohol and driving alcohol from slope G; (b) took a large voice, “Cunch, fran, francing, and francing, at any time and time, violated the inside,” and francing the F’s hand, francing it into the ground, and flaping it into the ground, booming the chest, 2:3 smuggling of the breast, and followed the performance of duties by a police officer assigned by a slope belonging to the same global area to arrest a flagrant offender with an intention to obstruct the performance of official duties of the Defendant, thereby hindering the police officer’s lawful arrest of a flagrant offender.

2. 피고인 A 피고인은 위 1.항과 같은 일시, 장소에서 김해중부경찰서 E지구대 소속 경사 G(39세)가 B에게 음주측정을 요구하였다는 이유로 이에 화가 나 “씨발놈아, 짭새면 다가. 언제 미행했나, 돌았나, 또라이새끼가.”라고 욕설을 하면서 손으로 G를 때릴 듯이 위협하고, 양손으로 G의 팔과 가슴 부위를 밀치고, 이에 G가 피고인의 공무집행방해 행위를 휴대폰의 동영상 기능을 이용하여 촬영하려고 하자 손으로 휴대폰을 쳐 바닥에 떨어뜨리고, 양손으로 G의 멱살을 잡고 수회 흔들고, 주먹으로 G의 어깨와 등 부위를 수회 때리고, G를 순찰차량의 보닛까지 밀어 붙인 후 주먹으로 얼굴 부위를 수회 때리는 등 폭행하여 경찰관의 음주단속에 관한 정당한 직무집행을 방해함과 동시에 G에게 약 3주간의 치료를 요하는 좌측 어깨 타박 및 염좌 등의 상해를 가하였다.
