Punishment of the crime
The Defendant is the actual operator of “F” located in the same address as the interest of the president of “E” in the Busan Gangseo-gu meat packaging processing company in Busan Gangseo-gu. G is the representative director of “(State) H”, “(State) J”, “L”’s representative director of “N”, “N”’s president, “O”’s president of “P” of the meat packaging business entity in the livestock products packaging and processing company, “Y”, “R”’s president, “B”, and “V”’s president.
Since the School Meal Electronic Procurement System in charge of school meal service procurement in various levels of schools is awarded a successful bid by a bidder who has submitted the highest price close to the sealed estimated price, it is highly likely to receive a successful bid as the price will be reflected differently with multiple code (a certified certificate of a corporation and a business operator).
In order to raise the possibility of winning the bid as above, the Defendant connected the “E” company of the Defendant and the “F” code representing the Defendant’s mother’s mother to the school meal service Electronic Procurement System (www.st. Shool.co.co.co.m.r.) to the different projecting, and displayed a different bid in collusion with the above G, I, K, K, M,O, Q, and S, respectively, in order to arrange the bid price in advance and bid for the school meal service procurement project.
around 13:20 on September 17, 2015, the Defendant offered a bid in collusion with the “E” and “F” code at the office located in Gangseo-gu Busan, Busan, to cover KRW 1,792,00 with the “E” code, and offered a bid in collusion with the bidding price at KRW 1,976,000 with the “F” code, from that time until April 29, 2016, the Defendant offered a bid in collusion with the bidding price at KRW 5,891 times via the “E” and the “F” code, and the Defendant conspired with G to cover the bidding price at KRW 1,792,00 with the “E” code from September 17, 2015 to April 29, 2016, the Defendant conspired with G to cover the bidding price at KRW 315,315,315,00,000,000 as attached Table 2,315,15,000.
