1. The Defendant’s KRW 48,455,758 for the Plaintiff and its related KRW 5% per annum from August 12, 2005 to November 4, 2015.
Reasons
1. Basic facts
A. The relation 1) The defendant is a company established as the Japanese chemical and industrial company on October 17, 1969 and converted into the Japanese chemical and industrial company on February 23, 197 and then changed to the current trade name on December 29, 199, and a factory producing asbestos products on the ground of Busan Dongdong-gu B (formerly changed to B) around October 1969 (hereinafter referred to as the "asbestos factory of this case").
(2) From February 20, 1986 to March 26, 1990, the asbestos plant of this case was newly built and manufactured asbestos products, such as asbestos yarn, asbestos capture, asbestos tape, asbestos log, etc., and subsequently closed the asbestos plant of this case. After that, the asbestos plant was moved to a mass acid and was manufactured by the end of March 26, 199, and suspended the manufacturing of asbestos products. (2) Network D (hereinafter “the deceased”) resided in the e-gu, Busan Metropolitan City, 1.2 km away from the asbestos plant of this case for about four years from February 20, 1986 to March 26, 190, the date of closure of the asbestos plant of this case.
The plaintiff is the husband of the deceased.
B. The asbestos storage plant of this case, which existed in Korea so far, has been located in most of 14 small and medium-sized businesses with less than 30 workers, and it is known that 9 medium-sized businesses in Busan, 2 in Ulsan, 1 in Ulsan, and 1 in the Chungcheongbuk are distributed. Among them, the business place with the highest number of workers and production are the asbestos plant of this case operated by the defendant. 2) The defendant produced the asbestos product of this case from December 12, 1969 to March 26, 190, and among them, at least 1,515 employees working in the asbestos storage plant of this case were confirmed to have been working in the asbestos storage plant of this case.
