Reasons
Punishment of the crime
The Defendant is a person who operates a marina business with the trade name “C” from the third floor of the building B in Busan Metropolitan City.
1. He shall not engage in massage for profit without obtaining a qualification as a inseminator accredited for a violation of the Medical Service Act;
The Defendant: (a) from May 23, 2019 to June 12, 2019, at the business establishment of the said marina; (b) from employment of not qualified as a massage club; (c) made the body of customers knife by causing them to knife their body by fingering their fingers and sprinks, etc.; and (d) received KRW 3 to 40,000 as the price therefor.
Accordingly, the defendant conspired with D and did not obtain recognition of qualification, but did not make a profit-making purpose.
2. Where a foreigner violating the Immigration Control Act intends to find a job in Korea, he/she shall obtain the status of sojourn eligible for employment under Acts and subordinate statutes, and shall not employ any foreigner who fails to meet such status of sojourn;
Nevertheless, around May 23, 2019, the Defendant paid 1,500,000 won benefits to a foreigner of Thailand nationality who has no status of stay for employment, and employed him as a marina office in the place of massage practice.
3. No one shall advertise to induce or induce any other person to buy sex in violation of the Act on the Punishment of Arrangement of Commercial Sex Acts, Etc.;
Nevertheless, from April 2019 to June 12, 2019, the Defendant distributed to many and unspecified persons a printed name of “Welveing Ilves. F when Ilves with Spans and girls,” and placed a foreign woman’s photograph, name, body room, etc. under the title “AS-11, BS-13, uniforms, Lone Stars, Skicks, and F” on the Internet website, and then placed a foreign woman’s photograph, name, body room, etc. on the following occasions: “Ilves, Wlves, end spaths, and Ilves, Ilves, Ilves, Ilves, Ilves, and Ilves, Ilves, Ilves, Ilves, Ilves, Ilves, Ilves.”
