Reasons

1. Basic facts

A. The defendant establishes and operates a F University, and the plaintiffs are professors working at the F University.

B. As to the remuneration of school personnel to whom the salary grade system applies at F.M. universities, the Defendant is in the past as follows.

On January 17, 2014, based on the former Regulations on Remuneration of Teaching Staff (hereinafter “former Regulations on Remuneration of Teaching Staff”) before the amendment, the salary system has been implemented for the majority of teaching staff. On January 17, 2014, the Defendant revised the former Regulations on Remuneration of Teaching Staff by a resolution of the board of directors of the board of directors and newly prepared the “Rules on the Operation of the Performance-Based Performance-Based Encouragement System of Teaching Staff” in accordance with the above revised Regulations on Remuneration of Teaching Staff. From March 1, 2014 to March 1, 2014, the performance-based performance-based incentive system for teaching staff has been implemented.

On the other hand, with respect to the enactment of the regulations on the operation of performance-based incentives for teachers and the revised regulations on the remuneration of teachers, a majority of teachers based on the collective decision-making method.

The purpose of Article 1 (Purpose) of the Defendant’s Articles of Incorporation (the Remuneration Regulations for Faculty Members before the amendment of January 17, 2014) is to provide for matters relating to the payment of remuneration for teachers and staff (hereinafter referred to as “school staff”) of the F University (hereinafter referred to as “this University”).

Article 3 (Definition of Terms) (1) The term "wages" means basic salaries paid by rank (including positions) according to the degree of difficulty and responsibility of duties and the period of service.

(2) The term "compensation" means the aggregated amount of salary and various other allowances.

(4) The term “increased in salary” means granting a salary grade higher than the current salary grade after the lapse of a specified tenure of office or under the provisions of this Decree.

(5) An annual salary means a basic annual salary and performance paid for one year from March 1 to February 28 of the following year.
