A. (i) Article 45 of the Defendant’s articles of incorporation provides that “The remuneration of teachers shall be separately prescribed by the Rules, subject to the resolution of the board of directors, depending on the qualifications, career, and the degree of difficulty and responsibility of duties.” The F University is enacting and implementing “the Regulations on Remuneration of Teachers and Staff” to provide for matters necessary for remuneration of teachers and staff (referring to teachers and general employees; hereinafter the same shall apply) in accordance with the said articles of incorporation.

According to the Regulations on the Remuneration of Teachers and Staff of Dol F University, remuneration refers to the sum of salaries and other various kinds of allowances (Article 3 subparagraph 1), teachers and staff may be paid necessary allowances in addition to salary within budgetary limits (Article 25 (1)), types of allowances, scope of payment, amount of payment, and other matters necessary for the payment of allowances shall be prescribed by the Rules, subject to the resolution of the board of directors.

(Article 25(2). Article 25(2) of the above Regulations on the Remuneration of Teachers and Staff is enacted and implemented to determine matters concerning the kinds, scope of payment, and amount of payment of the allowances to be paid to the teachers and staff pursuant to Article 25(2) of the above Regulations on the Remuneration of Teachers and Staff.
