A defendant shall be punished by imprisonment with prison labor for up to six months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Criminal facts

No person shall use illegally another person's resident registration number, receive insurance benefits or aid and abets another person to receive insurance benefits by fraud or other improper means.

Nevertheless, around June 5, 2019, the Defendant received insurance benefits from each medical institution using the resident registration number of Daejeon-gu Daejeon-gu B and 2 as if the Defendant was D, and received insurance benefits with D’s resident registration number (E) and name as if the Defendant had been D, and received insurance benefits with “an impediment to the commencement and maintenance of waters” (influence), and as such, he/she knew of the fact that he/she had the aforementioned members within C apply for insurance benefits costs to the National Health Insurance Corporation, and had the victim notified of the payment of the insurance benefits, bear 10,990 won, excluding the principal charges, from December 26, 2019, until December 26, 2019, the Defendant received insurance benefits from each medical institution using D’s resident registration number as if the Defendant was D, and caused each medical institution to file an application for insurance benefits costs with the victim and charged the victim with a total amount of KRW 496,644 won.

In this respect, the defendant used another person's resident registration number unlawfully, received insurance benefits by fraud or other improper means, and simultaneously acquired property benefits by deceiving another person.
