Reasons
Punishment of the crime
Ⅰ Under the underlying facts, Defendant A is the former representative director of D Co., Ltd. (hereinafter referred to as “D”) (hereinafter referred to as “D”) that is a planning real estate company, and Defendant C is the representative director of the said corporation; Defendant B is the representative of the said corporation; Defendant B continuously increased the real estate price in Jeju-do; Defendant A purchased and divided Jeju-do’s land and sold at a high price to obtain profits from the market price by selling the land at a high price; Defendant B, who was aware of the fact in the course of selling the former real estate, knew that the former real estate was owned by G and H in the name of the corporation, etc., in Seopo-do.
Ⅱ Criminal facts
1. On January 2015, Defendant A and Defendant B purchased KRW 50,336 square meters in total as KRW 2,308,640,00 in Seopo-si, J, K, L, M, N, andO owned by Defendant B, and the joint representative director of the said corporation. However, when Defendant B entered into a verbal contract at the intervals of the transfer of registration by dividing the said land into several parts, Defendant B entered into a false real estate transaction agreement with the competent authority to prepare a false real estate transaction agreement and submit it to obtain permission for land division.
A. On January 2015, Defendant B drafted a real estate transaction contract using a computer and printed out the name and personal information in the column for the location of the real estate in Seopo-si P, Seopo-si, Seopo-si, and the seller column after printing out the contract, Defendant B entered the name and personal information of Q, which he received from Defendant A in the buyer column, in the Myeonpo-si column, “400 square meters” in the Myeonpo-si column, and “Won 12,000,000 square meters (Won 12,000,000)” in the sale price column. The buyer’s name was affixed a seal.
