[Defendant A] The defendant shall be punished by imprisonment for eight months.

[Defendant B] Imprisonment with prison labor for a maximum term of one year and six months, a short term of one year and one year.

Punishment of the crime

Defendant

A was sentenced to six months of imprisonment for fraud at the Busan District Court on March 19, 2015, and the judgment became final and conclusive on September 15, 2015.

On December 2, 2014, at around 14:09, the Defendant reported a letter to the effect that “The Defendant will send the so-called so-called the so-called so-called “sale of the so-called so-called 7.50,000 won if he remitted KRW 7.50,00” to the Victim G who contacted with the Internet NAVVL bulletin board.

However, in fact, the Defendant did not hold the said crowdfunding, and even if receiving the money from the victim, the Defendant did not have any intent or ability to deliver the said crowdfunding.

Nevertheless, as above, the Defendant, by deceiving the above G, received 750,000 won from the above G to the Busan bank account under the name of the Defendant, and acquired it by transfer, from January 4, 2015, up to 18:30 on January 4, 2015, the Defendant acquired 1,050,000 won in total from three victims over three times, such as the attached crime list 1.

On November 15, 2014, the Defendant made a false statement to the victim H who posted a notice stating that “The purchase of new projecting crowdfunding will be made” on the Internet website at the end of Busan (hereinafter referred to as the “Internet”) around November 15, 2014, stating that “The Defendant would sell the new projecting crowdfunding to KRW 220,000,000,000,000,000,000,000,000,000,000,0000,000,000,000,000,000,000,000,000,000,000,000,000,00

As above, the Defendant, by deceiving the victim, received KRW 220,00 from the Busan Bank Account (Account Number J) in the same day.

In addition, from that time until February 25, 2015, the Defendant is the victim at least 32 times in total, as shown in the annexed Table 2.
