A defendant shall be punished by imprisonment for six months.
However, the execution of the above sentence shall be suspended for a period of two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
Defendant was satisfus in Jeonju-si C
D Operation of the “E” restaurant in the name of “E”, and the credit card was issued under the said D name and used it.
1. The Defendant pretended to be the representative of the above restaurant, and applied for a credit card under the name of Samsung Card Co., Ltd. for the credit card, and signed the receipt confirmation on November 10, 2014, stating that “A” column for personal information essential consent, column for personal information essential joint signature, column for personal information essential joint signature, column for personal information selection, and column for personal information selection, and signed the document after stating “D” in the column for personal information selection.
Accordingly, for the purpose of exercising the right and duty, the Defendant forged a letter of application for issuance of a private document in the name of D, a receipt certificate, and a letter of consent on the provision of Samsung C non-products, and exercised the following as if the aforementioned forged documents were duly formed, upon receipt of one copy of Samsung Credit Card, to an employee under the name of the above Samsung Card Co., Ltd., who is unaware of the forgery.
2. The Defendant, in relation to the victim Samsung Card Co., Ltd., presented an application form for issuance of a forged card at the time, place, as described in paragraph 1, and a receipt certificate, and an essential written consent form for the provision of Samsung C&C services, and acquired it by deceiving the employees of the victim company in a name-free manner.
3. On December 4, 2014, the Defendant purchased goods equivalent to KRW 148,700 from “G” operated by a victim’s name in F A, Dong-dong, Sung-nam-si, Sungnam-si, Seoul-si, Seoul-si, and gathered the name of Samsung, as described in paragraph (1) of the above.
