그럼에도 피고인들은 공모하여, 2014. 7. 11.경부터 같은 달 31. 10:40경까지 위 ‘D’ 게임장에서, 30여평 규모의 점포에 ‘동물농장Ⅱ’ 게임기 40대를 설치하고, 당초 ‘동물농장Ⅱ’ 게임기가 게임 사용자의 적극적인 참여를 필요로 하는 순수 능력 게임으로서 단순 조작 또는 외부장치 등을 이용하여서는 경품을 획득할 수 없는 게임으로 등급분류를 받았음에도, 게임자동진행장치인 속칭 ‘똑딱이’를 게임시작버튼 위에 올려놓으면 게임 사용자의 조작 없이도 게임이 자동으로 진행되고 특정 점수 당첨 구간이 나오게 되면 이를 알려주는 예시 음악이 나오고 그 특정 구간에 진입하면 이용자의 조작과 무관하게 양만 명중시켜 5,000점을 계속 획득하고 5,000점마다 경품 1개가 배출되는 등 연타기능을 가진 것으로 개ㆍ변조된 ‘동물농장Ⅱ’ 게임물을 그곳을 찾은 불특정 다수의 손님들에게 제공하고, 손님들이 위 게임기의 이용을 통하여 획득한 경품 1개당 성명불상의 환전업자로부터 10%의 수수료를 공제한 현금 4,500원으로 환전받으면, 위 영업기간 중 매일 23:00경 대구 달성군 현풍면 현풍중앙로 129-10에 있는 ‘현풍버스터미널’ 뒷길에서 위 환전업자가 보낸...
