A and D are unemployed owners of "J Gameland" on the first floor of the Seogu-gu I, and Defendant C are managers of "J Gameland" above, Defendant E are day managers, Defendant E are day managers, Defendant B are night managers, K, L, and M (Suspension of Prosecution on the same day).

피고인들은 공모하여 게임 물관리 위원회로부터 등급 분류 받은 내용과 다른 내용의 특정 애니메이션 출현 횟수 기록 및 캐릭터 숫자와 종류의 변조기능, 게임 자동 진행장치인 일명 ‘ 똑딱이 ’를 이용한 점수 획득 기능 등이 있는 게임 물을 손님들의 이용에 제공함으로써 사행성 게임 장을 운영하기로 결의하고, 수사기관에 단속될 경우 사행성 게임 장을 운영하여 처벌 받은 전력이 없는 피고인 C이 나 서서 사행성 게임 장 운영으로 인한 동종 전력이 있는 실제 업주인 피고인 A을 보호하고 대신 처벌 받기로 역할을 분담하였다.

그럼에도 불구하고 피고인들은 공모하여 2014. 10. 말경부터 2014. 12. 16. 14:20 경까지 대구 서구 I 지하 1 층에 있는 ‘J 게임 랜드 ’에서, ‘ 넘버 포’ 게임 기 19대, ‘ 마녀 사냥’ 게임 기 20대를 설치하고, 당초 등급 분류를 받은 내용과 다르게 위 ‘ 넘버 포’ 게임 기의 게임 진행 과정에서 특정 캐릭터( 흰색 도복을 입은 남성) 와 함께 ‘YOU WIN' 이라는 영상이 출현되고 게임기 재부팅 시 출현 횟수가 기록되고, 기록된 숫자에 따라 게임 재시작 시 출현하는 캐릭터의 숫자와 종류가 달라지며, 게임기 조작 버튼 위에 게임 자동 진행장치인 일명 ’ 똑딱이 ‘를 올려놓으면 게임이 자동으로...
