Defendant

A Imprisonment for one year, and each of the defendants B shall be punished by imprisonment for eight months.

However, for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

The defendants are Chinese nationals who enter and stay in the Republic of Korea with the status of stay in foreign nationality Koreans (F-4).

1. Defendant A

가. 공문서위조 피고인은 제주에서 무자격 관광 가이드 일을 하던 중 단속이 심해지자 여행사에 제출하기 위한 관광종사원 자격증을 위조하기로 마음먹고, 2015. 8.경 제주시 E, 3층 피고인의 집에서 중국 인터넷 검색 사이트 ‘F’에서 검색을 하여 알게 된 중국 천진에 있는 상호 불상의 인쇄사에 한국관광공사 사장 명의로 된 피고인에 대한 관광종사원 자격증 1장을 위조해 달라고 의뢰하면서, 모바일 메신저인 위챗을 통해 피고인의 인적사항, 증명사진, 인터넷 검색 사이트 네이버에서 다운받은 타인의 관광종사원 자격증 사진을 전송하고 계좌 이체로 한화 3,500원을 지급하였다.

이에 따라 피고인의 의뢰를 받은 성명불상자는 컴퓨터를 이용하여 피고인으로부터 받은 관광종사원 자격증 사진에 피고인의 증명사진을 합성하고 자격증번호 란에 ‘G’, 성명 란에 ‘A', 생년월일 란에 ’H.‘, 발행일자 부분에 '2013년 11월 23일'이라고 입력하여 저장한 후 위와 같이 변경한 자격증 사진 파일을 위챗을 통하여 피고인에게 전송하였으며 피고인은 프린터로 위 자격증을 출력하였다.

Accordingly, the defendant, in collusion with the above-mentioned persons, forged a tourism worker qualification certificate for the defendant who was the president of the Korea National Tourism Organization for the purpose of exercising the rights.

B. Around September 1, 2015, the Defendant: (a) taken a false tourist employee qualification certificate with a cellular phone; and (b) exercised the above qualification certificate by transmitting it to the electronic travel agent located in Jeju as if it were actually issued, around that time.

C. The Defendant is commissioned by the Minister of Culture, Sports and Tourism to forge private documents.
