Reasons
Criminal facts
On April 6, 2016, the Defendant was sentenced to imprisonment with prison labor for two years at the Seoul Central District Court for fraud, etc., and the execution of the said sentence was terminated on January 26, 2018.
1. The Defendant, who caused a traffic accident by putting a part of the rear of the vehicle driven on the side streets and facing with hand, arms, etc., was aware of the injury as if he were injured, by the method of pretending that he was injured, in order to acquire money from the driver or the insurance company under the pretext of medical treatment or agreement.
On August 5, 2018, around 19:00, the Defendant found that the Defendant was from the backway near the Hanmyeong Station located in 405 as Seoul Dongdaemun-gu, Dongdaemun-gu, Seoul, and found out that the Victim B was from the 3-si facing the Defendant’s hand at the back of the said vehicle, and that the victim was injured due to the said accident, and then requested medical expenses and received KRW 20,000 for medical expenses in the said place. From that point of time to January 31, 2019, the Defendant received KRW 20,000 in total by the same seven times in total, such as the list of crimes Nos. 1,4,5,7,7,9 through 11 in the same manner as the list of crimes committed from that point of time to January 31, 2019.
Accordingly, the defendant was provided property by deceiving the victims.
2. On November 6, 2018, the Defendant attempted to commit fraud, around 14:10, at the front side of Dongdaemun-gu Seoul Metropolitan Government, found out that the Defendant was driven by the victim E from the front side of the F Cirs cruise passenger car, and some of the Defendant was faced with the Defendant’s hand at the rear of the said vehicle, and the Defendant demanded medical expenses by pretending that the victim was injured by the accident, but the victim did not comply with the request, but attempted to report to the police. From that point of view to February 7, 2019, the Defendant attempted to receive money in the same way five times in total, such as the list of crimes Nos. 2,3,6,8, and12, from that point of time until February 7, 2019.
