1. The plaintiff's claim is dismissed.

Details of the disposition

On September 1, 1987, the Plaintiff was appointed as a middle school teacher and served as a teacher in technical and family subjects, and from March 1, 2018, the Plaintiff served in B middle school.

On September 4, 2018, the Disease Teachers' Deliberation Committee of the Gangwon-do Office of Education deliberated and resolved on ex officio leave of absence for the plaintiff.

On September 12, 2018, the Plaintiff filed an objection against the result of the Gangwon-do Office of Education Deliberation, and the Gangwon-do Office of Education dismissed the Plaintiff’s objection on September 18, 2018.

On October 1, 2018, the Defendant issued a temporary retirement for illness to the Plaintiff.

(2) On September 27, 2018, the Plaintiff filed a petition with the Appeal Commission for Teachers’ Leave for Appeal seeking revocation of the instant ex officio leave. However, on January 2, 2019, the said Commission dismissed the Plaintiff’s above claim.

[Ground of recognition] The plaintiff's assertion as to the legitimacy of the disposition of temporary retirement in this case is not a disease teacher.

The details of the Plaintiff’s filing of civil petitions with the National Examination Board are the public interest report-based civil petitions, and the Plaintiff also obtained the certificate of qualification after receiving the first class of the 9th school management consultant qualification training at C University.
