1. Defendant A shall be punished by imprisonment with prison labor for one year.

However, the above sentence shall be executed for a period of two years from the date this judgment became final.

Punishment of the crime

The Korea Rural Community Corporation C branch office (hereinafter “C branch office”) of the Korea Rural Community Corporation established a contract with D on March 8, 2010 for the dredging project, and D entered into a contract for the dredging project of F reservoir located in North Korea on December 27, 2013 with H and selling aggregate generated from the dredging project site due to the debt while the dredging project was operated. Defendant A was employed by D’s operator I to manage the dredging site, and Defendant B was in charge of the said dredging project at the head of C branch office from January 20, 2014 to August 18, 2015.

1. Defendant A

A. In order for thief Co., Ltd. to take out dredging soil from the F reservoir, the thief Co., Ltd. passed the valley at each time, measured the shipment volume, and reported the shipment volume of the end of each month to C branch offices, but the Defendant, despite the fact that he did not pass through the valley, did not want to take out the dredging soil without permission and sell it to others.

(1) From May 13, 2014 to June 25, 2014, the Defendant: (a) extracted aggregate from the said F reservoir using a dump season and dump truck; and (b) removed aggregate without passing through the dump; and (c) stolen aggregate amounting to approximately KRW 26,240 cubic meters of market value and KRW 26,930,000 owned by the Republic of Korea.

B. From Jun. 5, 2015 to Jun. 8, 2015, the Defendant extracted aggregate from the said F reservoir using a schof truck and dump truck, and then removed aggregate from the said F reservoir without passing through the schof truck without passing through the schof, thereby thefting approximately KRW 1,000 cubic meters owned by the injured Republic of Korea and the market value of KRW 6,775,00.

B. The Defendant of the offering of a bribe refers to a request to B for the removal of miscellaneous trees from J Dam that is scheduled to place an order at the C branch on April 2015 at the early stage of dredging work of the F reservoir B, and “the removal of miscellaneous trees from J Dam” from B.
