A defendant shall be punished by imprisonment for six months.
However, the execution of the above punishment shall be suspended for one year from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
1. Around April 13, 2018, the Defendant used computers, etc., known the card numbers and passwords of his/her credit card No. D, which were hospitalized in Daejeon Jung-gu, Daejeon, Daejeon-gu, C, and his/her consciousness, and had a mobile phone in D’s name, and used the same to obtain credit card loans through the aforementioned mobile phone.
In fact, although the defendant did not obtain D's consent or consent, he entered D's credit card information into the data processing device such as a computer without authority, received a credit card loan of KRW 8,00,000 from the victim E card on June 12, 2018, and transferred D's cell phone to the F account in the name of the defendant to the bank bank using the mobile phone in the name of the defendant. From around that time to July 2, 2018, the defendant acquired property profits equivalent to KRW 9,705,000 in total from the victim three times in total, such as the list of crimes (I).
2. On July 6, 2018, the Defendant, at the He Association cultural center located in Jung-gu Daejeon, Daejeon, for the purpose of obtaining a H Association Mutual Aid loan, was willing to get a re-issuance of the H Association passbook in the name of D.
The Defendant forged private document: (a) stated D in the name column of “D”, “B-gu I Apartment J”, and “D” in the signature column in the name column of the “written application for CD/ATM loan”; and (b) affixed D’s seal in the name column of the “written report on accident, modification, etc.” with a black-type color-type seal attached to the “written report on treatment”; (c) stated D’s name in the name column of “D”, “K’s date of birth”, “L” in the cell phone column, “L”, and “L” in the cell phone column or the reporter column; and (d) affixed D’s seal attached to the “written consent to collect, use, and provide personal (credit) information” (mutual loan); and (d) stated the date of birth, “M’s name” and “D’s name” in the “written consent” column and had the seal affixed to D’s name after signing it.
