A defendant shall be punished by imprisonment for not more than ten months.

However, the execution of the above punishment shall be suspended for two years from the date of the final judgment.

Punishment of the crime

[2013Kadan6362] The Defendant purchased a mobile phone in the name of another person with a mobile phone, and sold the mobile phone without paying a full payment of the mobile phone price and sold it to acquire profits.

1. The crime committed on August 10, 2013;

A. At around 13:00 on August 10, 2013, the Defendant forged private documents without authority for the purpose of exercising the right at the SK Telecom agency located in Gangnam-gu Seoul, Seoul, and then entered “D”, “E”, “E”, and “D” in the name column of customer information on the application for subscription of the mobile phone service contract in the name column of the mobile phone service contract, and signed next to that.

Accordingly, the defendant forged a new contract for mobile phone service in the name of D, which is a private document on rights and obligations.

B. The Defendant: (a) submitted to G, an employee of the foregoing agency, who was aware of the fact at the above date, at the above time and place, the said contract was duly prepared; and (b) exercised it.

C. The Defendant violated the Resident Registration Act, at the above date and place, entered “H”, which was the resident registration number of D, which was known in the resident registration number column of the said contract, as a color pen, and submitted the said contract to G to the said G to unlawfully use another person’s resident registration number.

In the above date, at the place of the fraud, the defendant purchased one gallon of S4 mobile phone at the market price of 954,800 won, and the defendant galloned the victim G as if he was D, and his identification card will be left later, and the defendant made a false statement.

The defendant obtained one cell phone from the victim at the seat, namely, the above mobile phone, and acquired it by fraud.

2. A crime on August 29, 2013;

A. On August 29, 2013, at around 20:45, the Defendant forged private documents without authority for the purpose of exercising it at a LGU agency located in Seongbuk-gu, Sungnam-gu, Sungnam-si, and without authority, refers to D’s name and address in the column for the name of the subscriber to the mobile phone service application.
