Punishment of the crime
[2015 order 201] The Defendant sentenced ten months to imprisonment for fraud, etc. in the Seogsan Branch of the Daejeon District Court on December 26, 2008, and completed the execution of the sentence in the Daejeon Prison on August 26, 2009.
【Criminal Facts】
Public interest service personnel shall not leave their service or fail to serve in the field concerned for at least eight days in total without justifiable grounds.
The Defendant retired from service for at least 4 days in total for five days from February 20, 201 to June 10, 201, for four days from June 7, 201 to June 14, 201, for two days from June 16, 201 to June 17, 201, for two days from June 16, 201 to June 17, 201, for five days from February 20 to February 24, 2012 without justifiable grounds.
[2015 Godan312] On April 9, 2013, the Defendant sold 210,000 won to the victim F who became aware of the Internet broadcast that relays the online game “Inman” at the French site, thereby selling 2.1 million won via the above Internet broadcast hosting. In so doing, the Defendant made a false statement to the effect that he would transfer money to the victim F.
However, even if the defendant receives money from the victim, he did not have the intent or ability to transfer the game money to the victim.
Nevertheless, the Defendant received 2,100,000 won from the victim to the Agricultural Cooperative Account under the name of the Defendant on the same day as the price for selling game money.
Accordingly, the defendant was given property by deceiving the victim.
[2015 Highest 315] On June 26, 2014, the Defendant: (a) took a theft by withdrawing KRW 1.4 million in cash twice through G’s cash card from the cash withdrawal machine managed by the victim at the victim-specific Cheongyang-si’s Cheongyang-si located within Cheongyang-si, Chungcheongnam-si; (b) around 13:21, 2014.
