A defendant shall be punished by imprisonment for six months.

Punishment of the crime

On September 6, 2011, the Defendant was sentenced to a suspended sentence of two years for obstruction of performance of official duties or interference with business at the Busan District Court on August 6, 201, and the said judgment became final and conclusive on September 14, 2011, and is currently under the suspended sentence.

1. On March 19, 2013, at around 20:30, the Defendant entered a cosmetic operated by the Victim C (V, 41 years of age) in Busan, YY-gu, and transferred the cosmetic, and thereafter, the Defendant expressed a bath to the victim requesting fees that “in-house, he will be inspected. Meet, he will throw away the knife with the knife, knife with the knife, and will not do so.”

The Defendant, as such, got the victim to attack and give up KRW 7,00,000 from the drinking victim, thereby acquiring pecuniary benefits equivalent to the same amount.

2. 업무방해 피고인은 위 제1항 일시, 장소에서 다른 손님이 피고인을 경찰에 신고하자 위 손님에게 “경찰에 신고했나, 씨발년 내가 칼로 찔러 죽여 버린다, 파출소 있는 사람들 전부 내 쫄다구다.”라고 욕설을 하고, 피고인을 제지하기 위해 위 장소로 온 근처에서 방앗간을 운영하는 E에게 "좆 같은 새끼, 병신, 등신, 니 죽여뿐다”며 욕설을 하고 손을 들어 때릴 듯한 태도를 보이며 약 30여 분 동안 위와 같은 방법으로 소란을 피워 미용실에 들어오려던 손님들이 들어오지 못하게 하는 등 위력으로 피해자의 미용실 영업 업무를 방해하였다.

3. The Defendant, at the time and place specified in the above Paragraph (1) above, expressed that the victim G, a police officer, who was called out after receiving a report of 112 on the date and place of the said Paragraph (1), expressed that the victim G, who was a police officer, was “the victim of the said cosmetic room” in a place where the victim’s police officer, etc. was located, to ask the case details, personal information, etc., of the case, and that “the victim shall do so with the same body of the said cosmetic.” While being arrested by the crime of interference with business, etc., the victim was only killed, and died of the said victim.
