Punishment of the crime
Defendant
A was the chairperson of the Dong of E apartment from November 201 to October 2013, 201, and Defendant B was a director of F, a corporation for the purpose of building construction business, etc. from April 1, 201 to April 1, 201, and Defendant C was the managing director of the above apartment from December 201 to December 2013.
On June 11, 2012, the above apartment house announced a bid to the effect that the company which has obtained a license, etc. related to the re-printing construction of the outer wall of apartment should select the lowest bidder as the successful bidder after restricting the eligibility for participation in the bidding. On July 20, 2012, G Co., Ltd. among participating in the bidding after meeting the above qualification around July 20, 2012, G Co., Ltd. shall be KRW 321,70,000, KRW 345,620,000, KRW 148,000, KRW 371,70,000, KRW 376,323,000, and KRW 376,300,000 for each bid price as the successful bidder.
However, around July 27, 2012, Defendant A, C, and P (hereinafter “Defendant A”) agreed to select the F as a successful bidder by having the aforementioned F Co., Ltd. F, the bidding price of the tender at the representative meeting of the above apartment complex, the bidding price of which is lower than that of Company G, which is lower than that of the bid price, at the meeting of the above apartment unit: Defendant A, C, and the above apartment unit, as a successful bidder; and Defendant A, on that spot, agreed to select the F as a successful bidder by having the Defendant B use the phone at the site, and then, Defendant B agreed to do so, and Defendant C again, Defendant C, at the lowest of KRW 50,000,000,000 from the bid price already submitted, to select the F as a successful bidder, and at the same time, Defendant B agreed to do so, at around 09:00 on July 28, 2012, Defendant C, at the lowest of KRW 200,000.
