1. The Defendant traded on August 12, 1994 with respect to the Plaintiff’s share 130.68/265 out of the Songpa-gu Seoul Metropolitan Government 178 square meters.

1. Basic facts

A. 1) Seoul Songpa-gu Seoul Metropolitan Government Da, E, F, G, H, I, J, K, and L land (hereinafter “instant apartment site”)

M, N,O, P, Q, R and the Defendant, the owner of the above land, removed the above-ground housing around 1991, and one apartment unit with the 19th underground floor and the 19th floor above the ground (hereinafter “the apartment of this case”).

(2) On June 17, 1992, the owner of the instant apartment site was granted a building permit for the new construction of the instant apartment site. At the time, the name of the owner was M, N,O, P, Q, R, and S (the owner of the instant apartment site entered as the owner of the instant apartment site among the owners of the apartment site).

The name of the owner of S was changed on June 19, 195 to the name of the defendant on April 19, 1996 and changed to the name of U on December 11, 1996, respectively, and changed to the name of V on April 12, 1999.

3) The instant apartment building was actually completed around October 1995 and remains unbuilt due to disputes between the owner and the construction business operator around May 24, 1999. After that, on or around June 1, 1999, registration of preservation of ownership was completed for each of the shares of each of the instant apartment units in the name of M, N,O, P, Q, R, and V, the owner of the building at the time of approval for use on or around June 1, 1999. (4) The instant apartment was registered for preservation of ownership for each of the instant apartment units in the name of M, N,O, P, Q, R, and V.

B. The ownership relation 1) Of the instant apartment site in Songpa-gu Seoul Metropolitan Government, the Songpa-gu Seoul Metropolitan Government 178 square meters (hereinafter “instant land”).

On August 2, 1991, the ownership transfer registration was completed from S on August 2, 1991, and the ownership transfer registration was completed on April 16, 1996 on April 15, 1996 on April 16, 1996 on the part of the defendant's Dong-dong, the defendant's Dong-dong, and the ownership transfer registration was completed on December 4, 1996 on December 4, 1996, in U.S., the defendant's wife, but the Industrial Bank of Korea registered the above T ownership transfer registration.
