The Selection E shall be appointed to the Selection G with respect to the share 65.34/2524.56 out of the 178m2 in Songpa-gu Seoul Metropolitan Government F.
Reasons
1. Basic facts
A. At around 1991, W, X,Y, Z, AA, AB, and Defendant B, the owners of the Songpa-gu Seoul N, O, P, Q, R, S, T, U, and V land (hereinafter “instant site”) decided to remove the instant site’s above-ground housing and newly construct one apartment unit (hereinafter “AC apartment”) with 19th underground floor and 10th underground floor (hereinafter “AC apartment”) around June 17, 192. 2) The instant site owners obtained the building permit for the new construction of AC apartment around W, X, Y, Z, AAB, AB, and AD (hereinafter “instant site owners”). At the time, the building owner was the owner of W, X, Y, Z, AB, AB, and D (hereinafter “instant site owners”).
AD owner's name was changed on June 19, 195 to Defendant B's name on April 19, 1996 and changed to AE's name on December 11, 1996, respectively. AD's name was changed to AF's name on April 12, 1999.
3) AC apartment was actually completed around October 1995 and remains unbuilt due to disputes between the owner and the construction business operator around May 24, 1999. After that, on or around June 1, 1999, registration of preservation of ownership was completed in relation to shares of 1/7 of each of the 19 households of WW, X,Y, Z, AAB, AC apartment under the name of the owner at the time of approval for use on June 1, 1999. (B) The ownership transfer registration was completed on August 2, 191 in the name of Songpa-gu Seoul, Songpa-gu, Seoul (hereinafter “instant land”). The ownership transfer registration was completed on August 2, 1991 in the name of AD, and on April 15, 1996, the Defendant’s ownership transfer registration was completed on April 16, 196.
2. However, the Industrial Bank of Korea filed a loan claim and a fraudulent act revocation lawsuit against Defendant B and AE’s heir G, etc. as Seoul Eastern District Court 96Gahap13437, and concluded a sales contract between Defendant B and AE on November 21, 1996.
