1. The plaintiff's claims against the defendants are all dismissed.
2. The costs of lawsuit shall be borne by the Plaintiff.
Reasons
1. Basic facts
A. D was subject to the assessment of the area of 4,334 square meters prior to the instant subdivision in Suwon-si, Suwon-si, around 1911, and thereafter, E is subject to the assessment of the area of 2,810 square meters prior to the instant subdivision, and 149 square meters prior to the instant subdivision (hereinafter collectively referred to as “the land prior to the instant subdivision”).
2) The registration of ownership transfer was completed in the name of the Republic of Korea on February 3, 1955, and the registration of ownership transfer was completed in the name of the Suwon Industrial Co., Ltd. on February 8, 1958 on March 12, 1955.
After that, the land before the division was transferred on July 23, 1968 due to each auction or sale on February 24, 1971, H, September 21, 1976, to I et al.
B. Of the land before the instant partition, the F 2,810 square meters was divided into 1,453 square meters of F site, 412 square meters of K site, 928 square meters of L site, and 17 square meters of L site around 193. From among the land before the instant partition, the ownership transfer registration was completed in the name of Sungwon Construction Co., Ltd. on September 7, 1994. The said J was divided into 280 square meters of roads and 132 square meters of M, and the said M was divided into 14,781 square meters of land around 196 (attached Table 16(6)), and the said M was divided into 14,781 square meters of real estate in the name of Defendant 14, 196 and 294 square meters of real estate (attached Table 16(1)), and the said list was divided into 14,781 square meters of land in the name of Defendant 14, 1996.
3. The registration of ownership transfer was completed on October 31, 200 with the above F site No. 1,453 square meters. The registration of ownership transfer was completed in Defendant C’s name on October 31, 200, respectively, and the F 450 square meters in size around May of the same year after being combined with F 2,212 square meters in around April 2005, and the F 450 square meters in size, S 227 square meters in size, and T 1,535 square meters in size.
