Punishment of the crime

On October 7, 2018, the Defendant sent a mixture of 153,000 won to the victims E who wish to purchase the mixture at “C” (D), a website for goods transactions.

“Along with the fact, the Defendant did not have any mixing, and the Defendant was able to receive money from the victim only from the beginning. On the same day, the Defendant sent KRW 153,00 from the victim’s account under the name of the Defendant (number G) for the purpose of selling mixed goods. From November 14, 2018, the Defendant received a total of KRW 6,961,300 in total 34 times, such as the entry in the List of Crimes (1) in the attached Form, from November 14, 2018. Accordingly, the Defendant received property by deceiving the victims. Around October 30, 2018, the Defendant sent the text message to the effect that “H”, which wants to purchase the Internet goods transaction site, sent KRW 40,310,00,00,00 to the victim.”

However, the defendant not only did not have a crowdfunding but also thought that he will receive money from the victim from the beginning.

Nevertheless, on the same day, the Defendant, by deceiving the victim as above, received KRW 310,00 from the victim’s J-securities account under the name of the Defendant (K) to transfer KRW 310,000 from November 28, 2018 to the Defendant’s account, and received a total of KRW 4,386,000 through 19 times as shown in the attached Table of Crimes List (2).

Accordingly, the defendant was provided property by deceiving the victims.

[118] On October 18, 2018, the Defendant: “Around October 18, 2018, the Defendant made a false statement to the effect that “the payment of money would be sold upon deposit” to the victim L who contacted through the Internet H website at a place that cannot be known; and that it received KRW 60,000 from the victim’s name Mbank account (N).
