Defendant shall be punished by imprisonment with prison labor for each crime of 200,00 won or a fine of 300,000 won or more, and for each crime of 2019 Highest 816, or 2019 Highest 3936.

Punishment of the crime

On October 24, 2018, the Defendant was sentenced to six months of imprisonment for fraud and two years of suspended execution at the Gwangju District Court on November 1, 2018 and the judgment became final and conclusive on November 1, 2018.

[2019Kadan816] Around November 6, 2018, the Defendant posted a letter to the effect that “I will sell a premium with access to a mobile phone app,” and “I will send the goods to the Defendant’s account in the name of the Defendant if I deposit KRW 320,000 to the Defendant’s account.”

However, in fact, the defendant thought that only the money he received as the price for the goods without the intention or ability to send the above premium.

As above, the Defendant, by deceiving the victim, received 320,000 won from the victim’s account (F) in the name of the Defendant from the victim, and received 8,370,000 won in total over 18 times from the victims, as shown in the attached Table 1, from December 17, 2018 to December 17, 2018.

However, the defendant did not actually have the intention or ability to sell goods.

On October 30, 2018, the Defendant deceptioned the victim as such, and acquired 230,000 won from the victim as the price for clothes.

[2019 Highest 3936] On June 6, 2019, the Defendant stated that “I will send the healthy food if you send the money.”

However, even if the defendant receives money from the victim, he did not have the intention or ability to send health food.
