1. The defendant shall be punished by imprisonment for eight months;
2.Provided, That the execution of the above sentence shall be suspended for a period of two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
When the Defendant, “2015 Highest 1337”, the Defendant, without any particular occupation, made it difficult for the Defendant to bear interest on the bonds, he/she saw that he/she sold false goods on the Internet portal site, posted a false article as if he/she had sold them, and she reported and contacted the fact against the persons who did not possess the relevant goods, or those who posted a writing wishing to purchase the goods, but he/she did not intend to raise funds, etc. to repay the interest on the bonds by receiving and deceiving the proceeds of the goods by means of money transfer.
Therefore, on November 18, 2014, the Defendant: (a) contacted the victim E who wishes to purchase a hotel's gift certificate using a mobile phone at the time of Daejeon, and then contacted the victim E who wishes to purchase a hotel's gift certificate; and (b) received 85,000 won from the victim to the bank account in the name of the Defendant (F) around that time.
In addition, the Defendant, from November 18, 2014 to April 18, 2015, by deceiving the victims as described in the annexed crime list (1) in the above manner, and received a total of KRW 3,356,000 on 51 occasions, and acquired the money, respectively.
On December 31, 2014, the Defendant, “2015 Highest 1611,” had access to the website of the Internet NAVER C, and, upon transmitting KRW 36,000 to the victims G who wish to purchase the USB, did not have any intent or ability to send the USB territory even if the said money was transferred.
The defendant, in its possession, received KRW 36,00 from the victim to the Nong Bank (H) account in the name of the defendant on the same day, and from that time, deceiving the victims as shown in the List of Crimes (2) from April 20 to April 20, 2015, and made them a total of 14 times as the price for goods.
