Reasons
Punishment of the crime
[Criminal Power] Defendant B was sentenced to seven years in Seoul High Court on December 27, 2016 to imprisonment with prison labor for a violation of the Act on the Aggravated Punishment, etc. of Specific Economic Crimes (Fraud), and the judgment became final and conclusive on March 30, 2017.
【Criminal Facts】
The Defendants conspired to acquire money by using a false lease contract as if the lease deposit for the lease contract concluded with respect to the real estate owned by Defendant A was a small amount.
1. Forgery of private documents;
A. In October 2014, the Defendants, at the D office of Defendant B’s operation located in Eunpyeong-gu Seoul Metropolitan Government, entered the “multi-household lease contract for multi-household housing” in the location column by means of computer networks in the form of “multi-household lease contract,” “F Building G of Seo-gu Incheon Metropolitan City, Seo-gu, Incheon Metropolitan City,” “10 million won in the column of deposit,” and “H building, I, and J of Gangseo-gu Seoul Metropolitan City” in the lessee column, and affixed the J’s seal to be inscribed in advance on his name.
As a result, the Defendants conspired to forge one copy of the multi-household lease agreement in the name of J, a private document on rights and obligations.
B. The Defendants, at the above date, at the place, and at the “multi-household housing lease contract form,” voluntarily stated “Seoul Metropolitan City K Building No. 5 L, Incheon Metropolitan City K Building No. 5 L, security deposit column, and “M and N” in the lessee column, and affixed N’s seal attached in advance to the name.
As a result, the Defendants conspired to forge one copy of the multi-household lease contract in the name of N, a private document on rights and obligations.
2. On October 31, 2014, the Defendants of the instant investigation documents filed an application for a loan of KRW 100 million with the P association located in Guro-gu Seoul Metropolitan Government, to the employees of the P association who are aware of the circumstances.
