A defendant shall be punished by imprisonment for not more than ten months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Criminal facts

1. Around 07:50 on December 19, 2014, the Defendant driving a mati truck under the influence of alcohol content of about 0.107% in the section of about 15 kilometers, from the front day of the influent garage located in the Seocho-gu, Jin-gu, Seoul Special Metropolitan City to the Changwon-Uan-Uan-ri exclusive road (not later than 500 meters prior to the Jinan-si road) located in the city of Jin-gu, Jin-gu, Seoul Special Metropolitan City.

2. The Defendant in violation of the Act on Special Cases concerning the Settlement of Traffic Accidents is a person who is engaged in driving a vehicle of marina freight.

피고인은 제1항의 일시경 김해시 진영읍 진영리 소재 창원-대산간 자동차전용도로(진영교차로 500미터 전)를 창원 방면에서 진영 방면으로 편도 2차로 중 2차로를 따라 진행하다가 술에 취하여 전방주시의무 및 앞차와의 안전거리확보의무를 태만히 한 과실로 앞서 진행하던 피해자 D(33세)이 운전하는 E 크레인 집게차 뒷부분을 피고인의 차량 앞부분으로 들이받아 위 D에게 약 2주간의 치료를 요하는 요추의 염좌 및 긴장의 상해를, 피고인의 차량에 동승 중이던 피해자 F(51세)에게 약 15주간의 치료를 요하는 발목을 침범하는 정강뼈의 개방성 골절, 아래다리 부분의 다발성 근육 및 힘줄의 손상, 족근골 부분의 골절, 비골 부분의 골절, 무릎뼈의 골절, 발허리뼈의 폐쇄성 골절, 고관절비구의 분쇄성 골절 등의 상해를 입게 하였다.
