Defendant shall be punished by a fine of KRW 15,000,000.

When the defendant does not pay the above fine, 100,000 won.

Punishment of the crime

Defendant 729 of 2015 is the actual representative of the D Medical Foundation E Hospital located in Seo-gu, Seoan-gu, Seoan-si, Incheon, who ordinarily employs 70 workers and operates the medical business.

When a worker dies or retires, the employer shall pay the wages, compensations, and other money or valuables within 14 days after the cause for such payment occurred.

Provided, That in special circumstances, the date may be extended by mutual agreement between the parties.

Nevertheless, the Defendant, from May 16, 2014 to September 30, 2014, did not pay 209,354,480 won in total from the date of retirement to 14 days from the date of retirement to 13 retired workers, including 3.7 million won on August 2014, with respect to retired workers F, as well as 3.7 million won, as shown in the list of crimes committed in the attached Table.

Defendant 1 is the actual representative of the D Medical Foundation E Hospital located in Seo-gu, Seoan-gu, Seoan-si, 2016, who ordinarily employs 70 workers and operates the medical business.

When a worker dies or retires, the employer shall pay the wages, compensations, and other money or valuables within 14 days after the cause for such payment occurred.

Provided, That in special circumstances, the date may be extended by mutual agreement between the parties.

Nevertheless, the Defendant did not pay 20,318,980 won, including 6,257,810 won from May 1, 2014 to October 1, 2014, in total, 20,318,980 won from the date of retirement without agreement on the extension of the payment date between the parties to the agreement on the extension of the payment date.
