Reasons
Punishment of the crime
1. Around August 2010, the Defendant, on the condition of paying the remaining installments of the Victim B’s Lone Star vehicle owned by the Defendant, was to use the said vehicle upon delivery from the victim and was in custody for the victim. On January 5, 2013, the Defendant: (a) at the corporate bond office of the first floor of the D D Building at Heung City in order to resolve the wage liability arising from the personnel office operated by himself/herself; (b) received KRW 700,00 from the nominal bondholder operating the said “E and embezzled the said Cone Star vehicle at his/her own discretion; and (c) embezzled it.
2. Forgery of private documents and the display of private documents;
A. At the same time and place as Paragraph (1) of this Article, the Defendant forged private documents: (a) stating that the above E company employees agreed to dispose of the Cone Starex vehicle without permission from B; (b) making the E office employees enter “B”, “F”, “F”, “B”, and “B” in the signature column in the form of the vehicle transfer certificate; (c) write one copy of the vehicle transfer certificate in the name of B, stating “B” and “B” in the letter of proxy form; and (d) write one copy of the proxy form in the name of B, stating “B” and “B” and “F” in the name column, resident registration number column, and address column of Gyeonggi-do, stating “B”, “C”, “B”, and “B” and “B” in the name column of the vehicle number column, thereby hindering the submission and preservation of the name of the vehicle; and (d) write one copy of the document form in the name “B” and causing interference with the issuance and preservation of the signature form.
Accordingly, the defendant, without authority, forged one copy of the car transfer certificate, power of attorney, vehicle abandonment certificate, and cash storage certificate, which are private documents related to the rights and obligations of the name B for the purpose of exercising.
B. The Defendant is holding a superior investigative document.
