1. On the Plaintiff (Counterclaim Defendant),
A. Defendant D, E, F, G, and Defendant-Counterclaim Plaintiff (Counterclaim Plaintiff) answer 1.
Reasons
A principal lawsuit and a counterclaim shall be deemed simultaneously.
1. Facts of recognition;
A. On October 19, 198, the Plaintiff entered into a lease agreement between the Plaintiff and the Defendant B with the Defendant on the following occasions: (a) on October 19, 1998, the Plaintiff: (b) on the part of Suwon-si, Suwon-si; (c) 1,021 square meters in Suwon-si, J 2,801 square meters; (d) K 2,298 square meters in common; and (e) on the other hand, each “I land”, “J land”; and (e) on the basis of parcel number, the lease deposit amount is five million won in lease deposit; and (e) on the basis of lease period from October 31, 1998 to 36 months; and (e) on October 31, 1990, the Plaintiff agreed that the lease agreement shall be paid in advance by converting the 2000 Gama 6,000 into the price of the neighboring goods of the U.S. dollars.
피고 B은 원고로부터 이 사건 각 토지를 임차한 후, 위 각 토지 지상에 별지 도면 표시 각 선내 “ㄱ”내지 “ㅇ”, “ㅌ”, “ㅍ” 부분 지상에 비닐하우스 10개동[이하 ‘이 사건 각 비닐하우스’라 하며, 1개동을 특정하여 지칭할 때는 각 별지 도면의 선내부분 구분표시로 특정하여 ‘이 사건 “(구분표시)” 비닐하우스’라 한다]을 지어 사용해 왔다.
B. On July 200, L’s acceptance of lessee status and each of the instant plastic greenhouses purchased L from Defendant B’s acquisition of the lessee status of each of the instant land (hereinafter “this case’s first acquisition agreement”), and received each of the instant land from Defendant B, and purchased each of the instant plastic greenhouse from Defendant B.
Lon November 5, 2012, paid to the Plaintiff the rent of KRW 3.78 million for each of the instant land in the year 2013 (from October 31, 2012 to October 31, 2013).
다. L의 이 사건 각 토지 무단 전대와 피고 H의 이 사건 각 비닐하우스 매수 L은 원고의 동의를 받지 아니하고 피고 C에게 K 토지 및 이 사건 “ㅌ”, “ㅍ” 비닐하우스를 전대해 주었다.
