A defendant shall be punished by imprisonment for one year.

However, the execution of the above punishment shall be suspended for three years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. On March 30, 2019, at the “D store located in Sungnam-si C, which is operated by the victim B on March 22:30, 2019, the Defendant: (a) obstructed the business; (b) obstructed the victim, who was under the influence of alcohol and was demanded by the victim to return home from the victim; (c) obstructed the victim’s disturbance, such as “Chewing strings, strings, and strings.”

Accordingly, the defendant interfered with the operation of the victim's store by force.

2. The Defendant assaulted the Defendant, on the date, time, and place indicated in Paragraph 1, on the ground that the said victim B (the age of 62) was prevented, and that he demanded the Defendant to grow out of the burial, by drinking, the victim B’s face is taken several times, and as a consequence, walking the victim’s private save, etc.

The Defendant continued to assault the victim E (the 59 years of age) by drinking a fighting match with the face and ear of the victim E.

3. 공용물건손상 피고인은 제1항 및 제2항 기재 혐의로 2019. 3. 30. 23:20경 성남시 F 앞 노상에서 임의동행 되어 G 쏘나타 순찰차 뒷좌석에 탑승하여 H지구대로 이동하던 중, 운전 중인 위 지구대 소속 경사 I에게 “야 이 씹할 개새끼야, 이거 존나 안 부서지네”라며 소리 지르고, 순찰차의 운전석 보호대 금속 부분과 조수석 뒷좌석 차문을 발로 수회 걷어차 뒷좌석 유리창 아랫부분(도어트립)이 움푹 들어가게 함으로써 수리비 약 187,000원이 들도록 위 순찰차를 손상하였다.
