1. Defendant B Co., Ltd. shall pay to the Plaintiff KRW 234,061,00 as well as to the Plaintiff from February 23, 2017 to March 5, 2018.
Reasons
1. Basic facts
A. The pertinent Plaintiff of the parties is a person who operates advertising agency and advertising materials production business with the trade name “D”, and Defendant B Co., Ltd. (hereinafter “Defendant B”) is a company established around September 22, 2016 for the purpose of real estate development sales agency business, etc., and Defendant C is the only internal director of Defendant B.
B. The details of the conclusion of the advertising agency contract between the Plaintiff and the Defendant B, and the purpose of this contract, Article 1 (Purpose of the Contract) of the Act on behalf of the Plaintiff (referring to the Defendant B; hereinafter the same shall apply) set forth matters necessary for delegation to B (referring to the Plaintiff; hereinafter the same shall apply) of the advertising affairs concerning “F” by the agency of the Plaintiff and the Defendant B, and aims to achieve the purpose of the contract by faithfully performing the contract in good faith and promoting mutual benefits.
Article 2 (Contents of Business and Scope of Advertising Items)
1. Business name: “F” (total 69 households);
2. The above franchisium Gunan-gun, Jeonnam-do.
3. Advertisement items: The scope of advertisement activities to be conducted under Article 3 (Scope of Business Activities) of all the advertising and sale advertising related to “F” enforced by A shall be as follows:
1) Article 5 (Business Procedures) of the affairs related to the planning, production, execution, and management of various advertising promotions and advertising activities, including TV, radio, newspapers, magazines, the Internet, indoor and foreign advertising, bus advertising and subway advertising, and 3) the production and distribution of all kinds of advertising materials, including the time and time of production, production, execution, and management of the ground, and the production and management of the advertisement. Article 5 (Business Procedures) of the affairs related to the public relations and advertising activities, shall be executed after consultation with A, with the advertising planning, media planning, production, and budget. The mutual communication of opinions for the business procedures shall be made using e-mail (e-mail). Article 6 (Expenses for Advertisement), the planning and production of advertisements, and the cost of media, etc. shall be determined by mutual consultation with A in accordance with the standard table.
