1. The plaintiff's claims against the defendants are all dismissed.
2. The costs of lawsuit shall be borne by the Plaintiff.
Reasons
1. Facts of recognition;
A. The Plaintiff is a company with the purpose of producing advertising materials and acting as an agent. Defendant B is the representative director of E Co., Ltd. (hereinafter “E”), the agency agent of the business of constructing and selling new apartment units in Daegu-gu D, and Defendant C is the representative of the F regional housing association, the executor of the above business.
[Defendant C was the chairman of the Promotion Committee of the Regional Housing Association before the F Area Housing Association was established.]
On March 15, 2017, the Plaintiff entered into an advertising agency service contract (hereinafter “instant service contract”) with the Committee for Promotion of Regional Housing Association and the Committee for Promotion of Regional Housing Association and the Committee for Promotion of Local Housing Association on the Business indicated in the preceding paragraph (hereinafter “instant service contract”). At the time of the contract, the seal of the Committee for Promotion of Regional Housing Association and the seal of the Defendants are affixed to the contract. The Defendants’ seal impression and resident registration are attached.
Article 2 (Scope of Contents of Business of Advertisement Agency Service Contract)
1. Project name: (tentative) G (tentative) regional housing associations, and projects for the recruitment and sale of members thereof;
2. Location of place of business: Daegu Dong-gu D Private School.
3. Number of households: Total of 470 households of apartments.
4. A scheduled contractor for construction: The scope of advertising business conducted by the Plaintiff under Article 3 (Scope of Business Activities) of H is as follows:
1. Formation and execution of the budget for advertisements;
2. Production of media advertisements, including strategies for advertisements, the formulation of media plans, and the progress of such strategies and programs (including TV, radio, newspapers, magazines, the Internet, indoor or outside advertisements, bus advertisements, subway advertisements, etc., and the passage of time and space, purchase, and execution of such advertisements);
3. Manufacture and distribution of various advertisements (after-sale contracts for placards);
4. Planning, production, execution, and management of various promotional events;
5. Intervention to the model, contracts, execution management, etc.
6. All business activities related to public relations, propagation, and other advertising activities;
7. Other business affairs incidental to the execution of the advertisement to attain the purpose A. Article 8 (Total Advertisement Expenses)
1. The scale of the total advertising expenses shall be KRW 800,000,000 (excluding surtax);
2. The total advertising expenses shall be in accordance with the budget bill of the execution advertisement attached thereto;
