A defendant shall be punished by imprisonment for not less than eight months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

From November 22, 2006, the Defendant entered into a check contract with the head of Busan Bank in the name of the Defendant from November 22, 2006 and traded household checks.

On October 9, 2012, the Defendant issued a check number “E”, “3,00,000 won”, “1 copy of the household check in the name of the Defendant as of February 9, 2013” in the D office operated by the Defendant in Nam-gu, Busan, and “the date of issuance”, and presented the amount equivalent to KRW 12,00,000 in total as of 5,6,7,8 of the crime sight table 1.4, and the check amount to be paid by each holder during the period of payment. However, each holder was not paid as suspension of deposit shortage or transaction.

From June 11, 1990, the Defendant entered into a check contract with the former branch of the Busan Bank and traded household checks.

On November 13, 2012, the Defendant issued one check number “H,” the check amount “5,00,000,000 won,” and the date of issuance “I” under the name of the Defendant’s G office located in the Nam-gu Busan, Busan, and presented two copies of the household check as shown in [Attachment 2.3, 4] No. 3, and the check amount “10,000,000 won,” and each holder presented it within the period of presentment for payment. However, the Defendant issued two copies of the household check as described in the [Attachment 2.3, 4], and presented it as a result of the shortage of deposits or the disposition of suspension of transactions, respectively.

around December 18, 2012, the Defendant issued one check number “J”, “5,00,000 won”, “date of issuance”, and “one check under the name of I” as stated in the attached Table 5. Around December 18, 2012 in the office of “G” in the operation of the Defendant in Busan-gu, Busan-gu, and presented it within the period for payment. However, each holder issued a check equivalent to KRW 4,00,000,000 as stated in the attached Table 5.
