A defendant shall be punished by imprisonment with prison labor for not more than ten months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. On February 6, 2019, the Defendant was under the influence of alcohol with a blood alcohol level of 0.18% without obtaining a driver’s license on February 23, 2019, the Defendant driven the E-Poter truck at a section of approximately 12km in the front of Ulsan-gu B on the road located in Ulsan-gu B, Ulsan-gu, Ulsan-dong C.

2. The Defendant violated the Resident Registration Act on the road at the time and time stated in paragraph (1) and used another person’s resident registration number unlawfully by leaving the Defendant’s type H’s resident registration number in advance, when he was asked to present his driver’s license by G Inspector G of the Ulsan Eastdong Police Station.

3. At around 23:32 on the same day, the Defendant: (a) sought from the above G to sign a letter of inquiry on the results of the crackdown on drunk driving with respect to H, which was entered into a portable police information device at the above G on the road; (b) and (c) exercised the part of the above inquiry, which is a prior recording of the certification of facts, among the results of the restriction on drunk driving, by signing a digital signature on February 6, 2019, on the side of the part stating “A driver H”; and (c) presented it to G, which is a prior recording of the certification of facts related to the certification of facts.

4. The Defendant, at the above-mentioned road at the time and time as indicated in paragraph (3), shall be a driver in the name of H, a private document concerning the fact-finding report, signed without authority, for the purpose of exercising the following part of the above-mentioned report stating, “I shall confirm that the above facts are true, shall be notified that his license is cancelled due to the primary driving, and I shall be notified that I will recognize the result of measurement and collect blood, but will not want it (the driver’s statement column).”
