Punishment of the crime
[Public subscription relation] Defendants were exposed to the Republic of Korea on March 25, 201, and Defendant A entered the Republic of Korea on or around December 25, 201, and were exposed to illegal stay on or around April 8, 2016. Defendants B were exposed to the Republic of Korea on or around August 22, 2018 and were compelled to enter the Republic of Korea again due to difficulties in re-entry of the Republic of Korea after having been discovered the means of entering the Republic of Korea on or around May 2020, she heard that C (No indictment of June 26, 2020), which is the land owner, entered the Republic of Korea, (No indictment of June 23, 202), and were arrested on or after having been released from the Republic of Korea on or around August 22, 2013 (No indictment of detention on June 23, 200), and were arrested on or after having entered the Republic of Korea (No indictment of June 20, 2005).
【Criminal Facts】
(a) Where a foreigner violating the Immigration Control Act intends to enter the Republic of Korea, he/she shall undergo an entry inspection at the entry and departure port of entry;
At around 20:00 on May 20, 2020, the Defendants conspired with six above D, etc., and boarded and departing from the motor boat purchased at the coast near the territory of the Sinsung for the sake of Chinese nives, following the above conspiracy, and then, on the 11:23 of the same month, the Defendants were driving the said motor boat, and entered the Republic of Korea after anchoringing it to the coast near the port of port and beach located in the Donan-gun, Yan-gun, Chungcheongnam-gun, Yan-gun, Yan-gun.
Accordingly, Defendants conspired with the above D, and entered Korea without undergoing entry inspection by immigration control officials at entry and departure ports.
(b) Any person or cargo that enters Korea in violation of the Quarantine Act shall undergo a quarantine inspection under the Quarantine Act;
Nevertheless, the Defendants conspired with the above D, and the same date, time and place as the above 1-A, and the above 1-A.
