이후 피고인은 같은 달 20. 경 위 산악회 첫 등산 행사 모임에 애초 회원들 로부터 회비를 각출하여 비용을 부담하여야 함에도, 총무를 맡은 D로부터 첫 번째 모임이니 회장으로서 모임 비용을 부담하여 달라는 부탁을 받고 이에 응하여 당일 각각 조합원인 총무 D, 남성 부회장 G, 여성 부회장 H 등 조합원 13명을 비롯하여, 그 배우자 등 산악회 회원 약 30 여 명이 참석한 위 산악회 첫 등산 모임의 관광버스( 경남 함 안 E ↔ 경남 남해 다랭이마을 부근 산) 경비 70만 원 및 등반 후 함 안 I 소재 J 식당에서의 저녁식사 비용 28만 원 등 당일 행사 비용 일체 합계 98만 원 상당을 피고인의 자비로 지불하고, 귀가하는 관광버스 내에서 총무 D가 참석자들에게 당일 행사 비용을 피고인이 부담한 사실을 알리는 등 조합원이 설립, 운영하는 단체 인 위 산악회에 대하여 금전이나 재산상의 이익을 제공하는 기부행위를 하였다.
