When the defendant does not pay the above fine, 100,000 won.

Punishment of the crime

The Defendant, from May 8, 2013 to March 19, 2015, served as the head of a cooperative of a C Livestock Industry Cooperatives (hereinafter referred to as “CF”) from May 8, 2015, and was elected on March 11, 2015.

1. No head of any agricultural cooperative that violates the Agricultural Cooperatives Act shall provide money, goods, or other property benefits, or make an expression of intent to provide such benefits or make an contribution to an institution, organization, or facility established and operated by a cooperative member, his/her family member, or an institution, organization, or facility while in office;

그럼에도 불구하고, 피고인은 2014. 7. 25.경 ‘2014년 사업계획 및 수지예산’에 근거가 없음에도 중복을 맞이하여 임직원 및 대의원들에게 삼계를 공급하기로 마음먹고, A4 용지에 “(직책명)님, 여름의 무더위와 장마ㆍ태풍으로 인한 비로 날씨를 종잡을 수 없는 시기입니다. (중략) 일일이 찾아뵈어 인사드리지 못하고 서면으로 인사를 드리게 된 점을 이해하여 주시고 무더운 여름에도 건강을 지키시며 가정에 행복이 가득하시기를 기원합니다. 2014년 07월 25일. C축산업협동조합장”이라고 인쇄된 조합장 명의의 인사말을 시가 12,600원 내지 14,000원 상당의 생닭 2마리와 함께 개당 1,000원 상당의 포장용기에 담아 포장한 다음, 위 축협 본점 및 지점 별로 선정된 배송담당 직원들로 하여금 C축협의 임원 14명, 대의원 70명, 축산계장(작목반장) 17명 및 선거관리위원 5명 등 106명의 조합원들에게 이를 각각 전달하게 하였다.
