1. It is confirmed that an insurance contract entered in the separate sheet concluded between the Plaintiff and the Defendant is null and void.
2. The defendant.
Reasons
1. Basic facts
A. On February 28, 2009, the Defendant concluded an insurance contract with the Plaintiff and the Defendant as the insured on February 28, 2009, as indicated in the attached list that guarantees expenses for hospitalization of diseases, expenses for disease-disease, etc. (hereinafter “instant insurance contract”).
B. The Defendant paid the Plaintiff’s insurance proceeds from March 23, 2009 to April 11, 2009: (a) hospitalized at the Gwangju Sejong Hospital for twenty (20) days due to brain dust, etc.; and (b) hospitalized total of thirty (32) days from around that time on the ground of 32 occasions on the ground that he/she had been hospitalized at the hinitis, conical signboard escape certificate, and father-training life (hereinafter “instant accident”); and (c) received total of thirty (31,940,000 won from the Plaintiff according to the instant insurance contract.
