A defendant shall be punished by imprisonment for not less than one year and six months.

Punishment of the crime

1. On June 20, 2016, the Defendant: (a) around June 20, 2016, the Defendant: (b) lent KRW 20,000,000, out of KRW 30,000,000, to the victim D; and (c) lent KRW 20,000,000,000,000 to the victim D.

However, the Defendant had no intention or ability to repay 20,000 won or more after the lapse of the two months, even if he/she assumed the obligation, such as bonds, from May 31, 201 to August 18, 2016, and borrowed 20,000 won or more from the victim.

Nevertheless, the defendant deceivings the victim as above and caused the victim to pay 20,000 won of the deposit to the victim E, and offset this by the defendant himself/herself's obligation against E.

Accordingly, the defendant acquired financial benefits by deceiving the victim.

2. Around September 2016, the Defendant borrowed only KRW 5 million from among the premium to be received from E as the Defendant had to pay the card value to the victim at an infinite place on September 2016.

However, in fact, the Defendant did not have the ability or intent to repay even if he/she borrowed the above amount from the victim by bearing the obligation, such as bonds of at least KRW 100 million from May 31, 201 to August 18, 2016.

Nevertheless, the defendant deceivings the victim as above and caused the victim to pay 5 million won for the premium to the victim E.

Accordingly, the defendant acquired financial benefits by deceiving the victim.

3. On October 19, 2016, the Defendant: (a) borrowed only KRW 5 million as the Defendant had to pay the card value to the victim at an influence place around October 19, 2016; and (b) stated that he would complete payment immediately.

However, the Defendant, from May 31, 201 to August 18, 201, bears a debt of 100 million won or more from the victim, such as bonds.
