Reasons
Punishment of the crime
The defendant is under a divorce lawsuit since the end of August 2017, as between the defendant and the wife B.
The Defendant, in the name of B, intended to conclude a lease agreement with the Busan Shipping Daegu C and 1210 building (hereinafter “instant real estate”) and to forge the power of attorney and the lease agreement in the name of B in order to make profits therefrom.
1. Forging a private document with respect to power of attorney in the name B and uttering of a falsified investigation document;
A. On April 5, 2018, the Defendant entered the content that “B shall delegate all acts related to a real estate rental contract of this case to the Defendant” in the name of “B” and “B” into “B” and “resident address column in the name of “B” and “B” with the aim of exercising the said lease contract at the Defendant’s office located in Jung-gu, Busan, Busan, and 403, by means of a computer without the consent of B and permission, to enter “F” into “B” and then output it in “B” and “B” and “B” column.
B’s seal affixed the B’s seal and forged a letter of delegation in the name of the private document on rights and obligations.
B. On April 6, 2018, at around 10:00, the Defendant: (a) presented the forged power of attorney to H as if he/she were genuinely formed at the “G Authorized Brokerage Office” located in Busan Shipping Daegu C or 105, the Defendant: (b) presented the forged power of attorney to H as stated in the preceding paragraph.
2. Counterfeiting a private document on the lease contract in the name of B and using the document on investigation;
A. The Defendant, at the same time and place as Paragraph 1-B, had an authorized intermediary private person, who is not aware of such fact, enter into a lease agreement with I without the consent of B, enter into the lease agreement with I, and in the column of “the address of the lessor” as the title “real estate lease agreement” using a computer, “F” and “F”.
