A defendant shall be punished by imprisonment for not more than ten months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment became final and conclusive.

Punishment of the crime

The Defendant, at around 16:40 on November 6, 2018, is a passenger of Part II aircraft arriving at the Incheon International Airport around 05:35 on November 7, 2018.

The defendant committed the following crimes under the state that the defendant lacks the ability to discern things or make decisions due to the on-site illness, etc.:

1. No person shall make a noise, such as abusive language, loud singing, etc., on an airplane in flight in violation of the Aviation Security Act;

Nevertheless, at around 17:00 on November 6, 2018, the Defendant, at the seat (18B) of the Defendant on the second floor of the above aircraft, made a disturbance as shown in the annexed crime list between around 17:0 and November 7, 2018, in the above aircraft, the Defendant called “necessary weather” and the Defendant was refused.

Accordingly, the defendant committed a disturbing act such as abusive language, loud singing, etc. on an airplane in flight.

2. Around 01:00 on November 7, 2018, the Defendant provided the following information: (a) on the 2nd floor of the instant two-story, the Defendant: (b) directed the Defendant that the Defendant would have designated the Defendant as the victim; and (c) that the Defendant “Is the Defendant, 38 years old, seated the water contained in the instant two-story; and (d) assaulted the victim by spreading the water contained in the instant two-story.”

3. A property damage: (a) on November 7, 2018, the Defendant: (b) at the Defendant’s seat on the second floor of the aircraft in question, which was operating around 05:20 on November 7, 2018; (c) at the Defendant’s seat on the second floor of the aircraft in question; and (d) at the seat window (i) at the seat of the Plaintiff, he destroyed the front side of the G bus aircraft operated by the victim Co., Ltd. with approximately KRW 342,956 Evidence No. 49.
