A defendant shall be punished by imprisonment for four months.

However, the execution of the above punishment shall be suspended for one year from the date this judgment becomes final and conclusive.

Punishment of the crime

No passenger on board shall engage in any disturbing conduct, such as verbal abuse, loud singing, etc., to ensure the safe flight of an airplane and travel of passengers.

그럼에도 피고인은 2019. 8. 4. 17:30경 베트남 다낭국제공항에서 출발하여 대한민국 무안국제공항으로 운항 중인 B 항공기에 승객으로 탑승하여 술에 취한 채 아무런 이유 없이 “비행기를 폭파 시키겠다. 문을 열고 폭파시켜 버리겠다.”라는 등 폭언을 하면서 소리를 질러 승무원 C로부터 소리를 낮추어달라는 요청을 받자, “눈을 어디다 동그랗게 뜨고 쳐다보냐, 저거 미친년 아니냐. 내가 D에서 일을 했었다”라는 등 욕설을 하며 소리를 지르고, 계속하여 이를 말리는 승무원들에게 “너의 목을 따버리겠다. 좆같은 년 미친 년, 개 같은 년, 정신 나간 년, 너 E에서 잘리게 하겠다. 내리면 보자”라고 소리를 지르는 등 소란을 피웠다.

However, in addition to the fact that the defendant is the first offender with no criminal records, and the mistake is against the defendant, the punishment shall be determined as ordered in consideration of all the sentencing conditions shown in the records and arguments, such as the defendant's age, character and conduct, family relations, etc.
