A defendant shall be punished by imprisonment for a term of one year and four months.
19,900,000 won shall be additionally collected from the defendant.
Reasons
Punishment of the crime
On August 8, 2012, the Defendant was sentenced to a suspended sentence of ten months in the Seoul Northern District Court sentenced to imprisonment with prison labor for an injury, etc., and the judgment became final and conclusive on August 17, 2012.
Although the Defendant, who is not a person dealing with narcotics, was prohibited from purchasing or receiving a psychotropic drug clickphone (one clickphone, hereinafter “clickphone”), he dealt with the following clickphones:
1. On August 18, 2012, the Defendant remitted the purchase price of 300 to 3.5 million won for Handphones to an inorganic account used by D. On August 19, 2012, the Defendant: (a) sealed approximately 10g of Handphones in the Busan East-dong Office located in the Busan East-dong Office; and (b) purchased Handphones to the Defendant by means of the “KTX-specific Cargo” letter as agreed with the Defendant, as the Defendant had agreed in advance; (c) stated the sender E, addressee, F, reception address, Seoul Northern-gu G2, and product mixtures; and (d) received this on the same day and purchased Handphones.
2. At around 16:10 on September 11, 2012, the Defendant remitted the purchase price of 50,000 won in writing to the bank account (Account Number:K) in the name of J used by the Defendant at H’s bank account (Account Number): D; D on the same day, packing approximately 0.7g of opphones in the Busan East-dong-dong-dong-dong-gu Busan as a document bag; and then sent it to the Defendant using “KTX-P-P-P-P-P-P-P-P-P-P-P-P-P-P-P-P-P-P-P-P-P-P-P-P-P-P-P-P-P-P-P-P-P-P-
3. On October 28, 2012, the Defendant remitted 3.5 million won from the national bank account in the above H’s name to the bank account in the above J’s name used by D. On October 28, 2012. D on the same day, he packages approximately 10g of opon at the Busan Station located in the Seocho-dong-dong Busan, Busan, as he consulted with the Defendant, and then packages about 10g of opon with the Defendant.
