A Imprisonment with prison labor of 10 months and fines of 10,000,000 won, and Defendant B shall be punished by a fine of 5,00,000 won, respectively.

Punishment of the crime

1. Defendant A is the representative director of Defendant B, located in Jeonsung-gun C or D, who actually operates the said company.

No one shall falsely indicate the place of origin of agricultural and fishery products or the processed products thereof, or place a mark that may cause confusion with it.

A. From March 31, 2018 to May 24, 2018, Defendant A purchased the “F” at the location of Defendant B Co., Ltd., and manufactured “F” by subdividing 4,510kg from among them into “90% of the country of origin (including the detailed description of goods)” with the false indication of “100% of the country of origin labeling (including the product description)” in the “10% of the country of origin labeling (including the product description)” in the Internet shopping mall, such as G, H, etc., and sold “F” with the order consumers who ordered the purchase of the “F” by means of false indication of “32,760,496% of the market price.”

B. Defendant A from April 23, 2018 to May 24, 2018

In the places indicated in paragraph (1), I would like to purchase 12,100 kg for Chinese official approval bean in China by dividing it into 9,820 g for manufacturing “J” products, and falsely indicate the country of origin as “100 % (domestic)” in the Internet shopping mall, such as G and K, and sell “J” in the column of “place of origin labeling (including the detailed description of the product)” as “Korea Western, 100% domestic Western,” and “place of origin” as “Sari, 100% domestic Western,” and “Sari-do, Hongcheon-gun, Gangwon-do,” etc. to the consumers who reported it by falsely indicating it as “Sacheon-gun, 139,908 won.”

Accordingly, the Defendant sold a false country of origin labeling of processed agricultural and fishery products amounting to 119,90,404 won in total of the market price.

2. Defendant B, Defendant B, etc., aims at manufacturing and selling functional health foods.
